Introduction and Acceptance of Terms
Welcome to Misspoppin. These Terms and Conditions constitute a legally binding agreement between you, the user, and Misspoppin governing your access to and use of our comprehensive digital platform. This agreement encompasses our website located at misspoppin.in, our mobile applications available on various app stores, all associated digital tools, resources, content, and any related services that we may offer now or in the future, which we collectively refer to as the Platform or Services throughout this document.
By accessing, browsing, registering for, or using any part of the Misspoppin Platform, you explicitly acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy which is incorporated herein by reference. If you do not agree with any portion of these Terms or our Privacy Policy, you must immediately discontinue all use of our Platform and Services. Your continued use of the Platform following any modifications to these Terms constitutes your acceptance of such changes.
Misspoppin operates as a specialized digital platform designed to bridge geographical boundaries by connecting certified parenting coaches based in the United States with families residing in India who are seeking professional parenting guidance, support, and education. Our fundamental mission is to provide accessible, high-quality, professional parenting coaching services through innovative technology, thereby democratizing access to expert guidance that might otherwise be unavailable or difficult to obtain. We pride ourselves on our role as a facilitator and technology provider, creating meaningful connections that can transform parenting journeys across continents and cultures.
Understanding Our Platform and Services
Misspoppin functions primarily as a technology platform and facilitator rather than a direct service provider. We provide the digital infrastructure, tools, and marketplace that enable connections between independent parenting coaches and families seeking guidance. It is crucial to understand that Misspoppin does not itself provide parenting advice, counseling, therapy, or any form of direct professional services unless explicitly stated otherwise in specific circumstances. All coaching services, consultations, advice, and professional guidance are provided independently by certified coaches who use our platform as a means of connecting with clients.
The coaching services facilitated through our Platform are educational and supportive in nature, designed to enhance parenting skills, provide guidance on child development, offer strategies for managing challenging behaviors, and support overall family wellbeing. However, these services are explicitly not intended to be a substitute for professional mental health therapy or counseling, medical advice or treatment for physical or mental health conditions, legal advice regarding custody or other family law matters, or emergency services of any kind. If you or your child are experiencing a mental health crisis, thoughts of self-harm, or any emergency situation, you must immediately contact emergency services in your area rather than relying on our Platform.
The coaches who operate through the Misspoppin Platform are independent professionals who maintain their own practices, professional credentials, and methodologies. They are not employees, agents, or representatives of Misspoppin. We do not supervise, direct, control, or dictate the specific coaching services provided by these professionals. Each coach is individually responsible for their own professional conduct, the advice they provide, their chosen coaching methodologies, and their adherence to professional standards and ethics. While we carefully vet our coaches through a comprehensive verification process that examines their certifications, credentials, experience, and professional standing, we cannot and do not guarantee specific outcomes or results from coaching services. Parenting situations are inherently complex, multifaceted, and individual, and results will naturally vary based on numerous factors including family dynamics, individual circumstances, commitment to the coaching process, and external variables beyond anyone's control.
Definitions and Key Terms
Throughout these Terms, we use specific terminology that carries particular meanings within the context of our Platform. Understanding these definitions is essential to comprehending your rights and obligations. A "User" refers to any individual who accesses or uses the Platform in any capacity, including both those seeking services and those providing services. A "Parent" or "Guardian" specifically refers to individuals who are seeking parenting coaching services through the Platform, whether they are biological parents, adoptive parents, foster parents, legal guardians, or other primary caregivers responsible for children. A "Coach" refers to certified parenting professionals who have been approved to provide coaching services through the Platform after completing our verification process.
The term "Services" encompasses all coaching sessions, consultations, educational resources, digital tools, platform features, content libraries, and any other offerings provided through the Misspoppin Platform. A "Session" refers to a scheduled coaching appointment between a Parent and a Coach, which may be conducted via video call, phone call, or other approved communication methods. "Content" refers comprehensively to all information, text, graphics, photographs, audio recordings, video materials, software, and any other materials available on or through the Platform, whether created by Misspoppin, our coaches, our users, or licensed from third parties.
Eligibility Requirements and Account Registration
To create and maintain an account with Misspoppin, you must meet certain eligibility requirements designed to ensure legal compliance and appropriate use of our Platform. You must be at least eighteen years of age or have reached the age of majority in your jurisdiction, whichever is greater. By registering for an account, you explicitly represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts. If you are accessing or using Misspoppin on behalf of an organization, company, educational institution, or other legal entity, you represent and warrant that you have the full authority to bind that entity to these Terms and that your use of the Platform on behalf of that entity constitutes acceptance of these Terms by that entity.
The account registration process requires you to provide accurate, truthful, complete, and current information about yourself. You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, and any other authentication methods. You must not share your account with others, allow others to access your account, or provide your credentials to any third party. You agree to notify Misspoppin immediately if you become aware of any unauthorized access to your account, any security breach, or any other security-related concerns. You are responsible for all activities that occur under your account, whether or not you authorized such activities, unless you can demonstrate that the unauthorized access resulted from factors entirely beyond your control and you took reasonable steps to prevent such access.
For individuals registering as Parents or Guardians seeking coaching services, you must provide valid contact information including email address and phone number, accurate payment details for processing service fees, and honest information about your parenting situation and needs to enable appropriate matching with suitable coaches. Providing false or misleading information may result in immediate termination of your account and may prevent you from using our services in the future.
For individuals applying to become Coaches on our Platform, the registration and approval process is more extensive and rigorous. You must submit comprehensive proof of relevant certifications, credentials, education, and professional experience in parenting coaching, child development, psychology, education, or related fields. You must maintain valid professional liability insurance coverage that meets our minimum requirements throughout your tenure on the Platform. You must commit to complying with all applicable professional standards, ethical guidelines, and regulatory requirements in both your jurisdiction and the jurisdiction of your clients. Your application to become a Coach is subject to our thorough verification and approval process, which may include background checks, credential verification, reference checks, and interviews. We reserve the right to accept or reject any Coach application at our sole discretion without providing specific reasons for rejection.
Misspoppin currently operates on an invite-only or controlled-access basis for certain features or user categories. Access to specific portions of the Platform may require an invitation code, referral from an existing user, or direct approval from our team. We maintain the right to accept or reject any registration application, to limit the number of users or coaches on the Platform, and to implement waitlists or other access controls at our sole discretion based on capacity, quality control, geographic considerations, or other operational factors.
User Responsibilities and Acceptable Use
All users of the Misspoppin Platform agree to use the Services only for lawful purposes and in accordance with these Terms and all applicable laws and regulations. You explicitly agree not to engage in any of the following prohibited activities. You must not violate any applicable local, state, national, or international laws or regulations, including but not limited to data protection laws, consumer protection laws, laws regarding professional services, and laws prohibiting fraud or deceptive practices. You must not impersonate any person or entity, misrepresent your affiliation with any person or entity, or provide false information about your identity, qualifications, credentials, or background. You must not transmit, upload, post, or otherwise make available any content that is harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, discriminatory based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics, or otherwise objectionable in our sole determination.
You must not interfere with, disrupt, or attempt to gain unauthorized access to the Platform, our servers, our networks, or any systems connected to the Platform through hacking, password mining, or any other illegitimate means. You must not use the Platform to collect, harvest, or compile personal information about other users without their explicit consent, whether for commercial purposes, spam, harassment, or any other reason. You must not engage in any fraudulent, deceptive, misleading, or manipulative practices, including providing false reviews, manipulating ratings or rankings, or misrepresenting the nature or quality of services. You must not share your account credentials with others, sell or transfer your account, or allow unauthorized individuals to access your account. You must not use automated systems, bots, scrapers, or other technological means to access the Platform, collect data, or interact with the Services without our prior written permission.
Parents and Guardians using the Platform to access coaching services bear specific responsibilities beyond the general user obligations. You agree to provide accurate and honest information about your parenting situation, challenges, family dynamics, and any relevant background that may assist your Coach in providing effective guidance. You must attend scheduled sessions on time or provide reasonable advance notice of cancellation in accordance with our cancellation policy. You agree to treat Coaches with respect, professionalism, courtesy, and dignity at all times, recognizing that abusive or inappropriate behavior toward Coaches will not be tolerated. You understand that any recommendations, strategies, or advice provided by your Coach are provided for your consideration and you maintain full discretion regarding whether and how to implement such guidance. You agree to inform your Coach of any significant changes in your situation, new developments, or concerns that arise between sessions. You must not record sessions through audio, video, or any other means without obtaining explicit prior consent from your Coach, as unauthorized recording may violate privacy laws and professional ethics guidelines.
Coaches operating on the Misspoppin Platform accept additional responsibilities reflecting their professional status and the trust placed in them by clients. You must maintain current, valid professional certifications, licenses, and credentials as applicable in your jurisdiction and must immediately notify us if any certification or license is suspended, revoked, or becomes subject to disciplinary proceedings. You must provide services in accordance with applicable professional standards, ethical guidelines, and best practices in your field, maintaining the highest levels of professional conduct at all times. You must maintain appropriate professional boundaries with clients, avoiding dual relationships, conflicts of interest, or any conduct that could compromise the professional nature of the coaching relationship. You must keep all client information strictly confidential except where disclosure is required by law, where there is a risk of harm to the client or others requiring intervention, or where the client provides explicit informed consent to share specific information with specified parties.
Payment Terms, Fees, and Financial Obligations
Misspoppin charges fees for various services and features provided through the Platform. These fees may include session fees for individual coaching sessions charged on a per-session basis, subscription fees for ongoing access to the Platform or specific features charged on a monthly, quarterly, or annual basis, package fees for bundled services that include multiple sessions or combined offerings at potentially discounted rates, and other fees for premium features, resources, or services. All fees are clearly displayed in Indian Rupees before you commit to any purchase or subscription, and you will have the opportunity to review and confirm all charges before they are processed. We reserve the right to modify our pricing structure with reasonable advance notice to users, though price changes will not affect services you have already purchased or subscriptions already in effect until their renewal date.
Payment processing is handled through secure third-party payment processors that comply with industry-standard security protocols and data protection requirements. By providing payment information to the Platform, you explicitly authorize us to charge your designated payment method for all applicable fees, including initial purchases, recurring subscription fees, and any additional services you elect to purchase. You represent and warrant that you have the legal right to use any payment method you provide and that all payment information you submit is accurate and current. You agree to promptly update your payment information if it changes and understand that failure to maintain valid payment information may result in service interruption.
Our refund policy is designed to be fair to both users and coaches while accounting for the nature of professional services and the time commitment involved in scheduling and preparing for sessions. For Parents and Guardians, session fees may be eligible for full refund or credit if you cancel at least twenty-four hours before the scheduled session time, giving the Coach adequate notice to potentially fill that time slot. Cancellations made less than twenty-four hours before the scheduled session time are generally not eligible for refund, as the Coach has already reserved that time and may not be able to fill it on short notice. No-shows, where you fail to attend a scheduled session without any prior notice, will result in the full session fee being charged with no refund, as this represents the most significant imposition on the Coach's time and income. Subscription fees for ongoing platform access or feature subscriptions are generally non-refundable except as specifically required by applicable consumer protection laws in your jurisdiction, though you may cancel future subscription renewals at any time. We reserve the right to evaluate refund requests on a case-by-case basis considering extenuating circumstances, and we may provide refunds or credits at our discretion even in situations where our policy might not strictly require them.
For Coaches providing services through the Platform, payment for completed sessions will be processed according to our established payment schedule, which is disclosed during the onboarding process. We retain a platform fee, calculated as a percentage of each session fee, which covers the technology infrastructure, payment processing, customer support, marketing, and other services we provide to facilitate your coaching practice. This platform fee percentage is disclosed during your application and onboarding process. Payments to coaches are subject to verification that services were actually delivered as scheduled, and we reserve the right to withhold payment or issue chargebacks in cases of service delivery disputes, fraud, or violations of these Terms.
If you believe you have been incorrectly charged, overcharged, or charged in error, you must contact our support team within thirty days of the charge appearing on your account or billing statement. We will investigate all billing disputes in good faith and will work to resolve them promptly and fairly. However, we cannot guarantee that every billing dispute will be resolved in your favor, as the resolution will depend on the specific facts and circumstances of each case.
All users are responsible for any applicable taxes related to their use of the Platform, including but not limited to sales tax, use tax, value-added tax, goods and services tax, or other consumption taxes. Coaches are independently responsible for reporting income earned through the Platform and paying all applicable income taxes, self-employment taxes, and other tax obligations in their jurisdiction. Misspoppin does not provide tax advice, and you should consult with qualified tax professionals regarding your tax obligations.
Scheduling, Cancellations, and Session Management
Sessions between Parents and Coaches are scheduled through the Platform's integrated scheduling system based on Coach availability and Parent preferences. Once a session is scheduled, both parties receive confirmation and reminders through email, platform notifications, or other communication channels you have authorized. You are responsible for attending sessions at the scheduled time or providing adequate notice of cancellation in accordance with our policies.
Our cancellation policy balances the needs of both Parents and Coaches while encouraging commitment and reliability. For Parents seeking to cancel or reschedule a session, cancellations made twenty-four hours or more before the scheduled session time will typically result in a full refund of the session fee or a credit toward future sessions, at your preference. This advance notice allows the Coach to potentially offer that time slot to other clients, minimizing the impact of the cancellation. Cancellations made less than twenty-four hours before the scheduled session are generally not eligible for refund, as the Coach has reserved that time specifically for you and has limited ability to fill it on short notice. No-shows, where you fail to attend a scheduled session without providing any notice or communication, will result in the full session fee being charged with no refund available, as this represents the most significant imposition on the Coach who has prepared for the session and lost income by holding that time slot.
For Coaches who need to cancel or reschedule a session, professional standards require at least twenty-four hours advance notice except in genuine emergency situations. Emergency cancellations with less than twenty-four hours notice must be accompanied by a commitment to reschedule the session at no additional cost to the client at a mutually convenient alternative time. Coaches who engage in repeated last-minute cancellations or demonstrate patterns of unreliability may face warnings, suspension, or removal from the Platform, as reliability is fundamental to maintaining trust and quality in our coaching marketplace.
If technical problems with the Platform, communication systems, or internet connectivity prevent a session from occurring as scheduled, we will work collaboratively with both parties to determine the appropriate resolution, which may include rescheduling without additional charge, providing partial or full refunds, or offering credits toward future services depending on the circumstances and the extent to which the session was affected.
Intellectual Property Rights and Content Ownership
All content appearing on the Misspoppin Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, video content, digital downloads, data compilations, software, algorithms, and other materials, whether created by Misspoppin, licensed from third parties, or contributed by users, is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. The compilation, organization, and display of content on the Platform is also protected as collective work under copyright law.
Misspoppin or its licensors retain ownership of all intellectual property rights in the Platform itself and in any original content we create. You acknowledge that the Platform contains proprietary and confidential information that is protected by applicable intellectual property and other laws. You agree not to copy, reproduce, republish, upload, post, transmit, distribute, or create derivative works from content on the Platform except as explicitly permitted by these Terms or with our prior written consent. You may not decompile, reverse engineer, disassemble, attempt to derive source code from, decrypt, or otherwise attempt to discover the underlying code, structure, or algorithms of any software or technology that powers the Platform.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its content strictly for your personal, non-commercial use in accordance with these Terms. This license does not permit you to download, store, reproduce, transmit, display, perform, distribute, or otherwise exploit any content except as necessary for your authorized use of the Services. You may not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices that appear on or in connection with the Platform or its content.
You retain ownership of any content you create and submit to the Platform, including messages exchanged with coaches or other users, reviews and ratings you provide, feedback you submit, photographs you upload, or other user-generated content. However, by submitting content to the Platform, you grant Misspoppin a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media or format now known or later developed. This license is necessary for us to provide the Services, improve the Platform, and promote our offerings.
Coaches retain ownership of their proprietary coaching materials, methodologies, frameworks, worksheets, and other intellectual property they have developed independently. However, by participating on the Platform, Coaches grant Misspoppin permission to display their profile information, credentials, promotional materials, and general information about their coaching approach on the Platform for the purpose of connecting them with potential clients. This does not grant us rights to proprietary coaching methodologies or materials beyond what is necessary to operate the Platform.
Privacy and Data Protection
Privacy Policy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.
Data Collection
We collect information you provide directly, information collected automatically through your use of the Platform, and information from third-party sources as detailed in our Privacy Policy.
Data Security
We implement reasonable security measures to protect your information. However, no system is completely secure, and we cannot guarantee absolute security of your data.
International Data Transfers
As we connect users in India with coaches in the United States, your personal information may be transferred to and processed in different countries. We comply with applicable data protection laws regarding international transfers.
Session Recordings
Sessions may be recorded only with explicit consent from all parties. Any recordings are subject to strict confidentiality and may only be used for purposes agreed upon by all parties.
Confidentiality
Coach-Client Confidentiality
Coaches are expected to maintain confidentiality regarding all information shared during coaching sessions, except where:
Disclosure is required by law
There is a risk of harm to the client or others
The client provides explicit consent to share information
Platform Confidentiality
Misspoppin treats all personal information and session content as confidential, subject to the terms of our Privacy Policy and applicable laws.
Mandatory Reporting
Coaches and Misspoppin may be required to report certain information to authorities, including suspected child abuse, neglect, or imminent harm to self or others, in accordance with applicable laws.
Disclaimers and Limitations of Liability
Platform "As Is"
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
No Professional Relationship
Using the Misspoppin Platform does not create a professional relationship between you and Misspoppin. Any relationship is between the Parent and the individual Coach.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MISSPOPPIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO MISSPOPPIN IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
Jurisdiction-Specific Rights
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
Third-Party Services
The Platform may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third-party services.
Indemnification
You agree to indemnify, defend, and hold harmless Misspoppin, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
Your use or misuse of the Platform
Your violation of these Terms
Your violation of any rights of another person or entity
Your User Content
For Coaches: your provision of coaching services
Termination
Termination by User
You may terminate your account at any time by contacting our support team or using the account deletion feature in the Platform. Upon termination:
You will lose access to the Platform
Unused subscription fees are generally non-refundable
Scheduled sessions must be cancelled according to our cancellation policy
Termination by Misspoppin
We may suspend or terminate your account immediately, without prior notice, if you:
Violate these Terms
Engage in fraudulent or illegal activity
Abuse, harass, or threaten other users
Fail to pay applicable fees
For any other reason at our sole discretion
Effect of Termination
Upon termination:
Your right to use the Platform immediately ceases
We may delete your account information and User Content
Provisions of these Terms that by their nature should survive termination shall survive
Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Arbitration Agreement
Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in English in Haryana, India.
Exceptions to Arbitration
Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights or to enforce confidentiality obligations.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Informal Resolution
Before initiating arbitration, parties agree to attempt to resolve disputes informally by contacting our support team at support@misspoppin.in.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Misspoppin regarding the Platform and supersede all prior agreements.
Amendments
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, or strikes.

Language
These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
Special Provisions for International Services
Cross-Border Services
Misspoppin facilitates services between Coaches in the United States and Parents in India. Both parties acknowledge and accept the cross-border nature of these services.
Compliance with Laws
Users must comply with all applicable laws in their respective jurisdictions, including:

Consumer protection laws
Professional licensing requirements
Tax obligations
Foreign exchange regulations
Currency and Exchange Rates
All fees are displayed and charged in Indian Rupees (INR). Exchange rate fluctuations are not grounds for refunds or adjustments.
Time Zones
Sessions are scheduled based on Indian Standard Time (IST) unless otherwise agreed. Users are responsible for understanding time zone differences.
